A pedestrian was struck by a motorist who fled the scene. A Good Samaritan stopped to help the injured man who lay in the street with serious injuries. She told police that the driver of the car struck her car twice when attempting to flee.
According to police, the driver was captured by police a few blocks away with a damaged vehicle. They haven’t said what charges will be filed, but the suspect was placed under arrest and will be questioned.
When the woman first arrived on the scene, she saw the injured man on the hood of the car before he fell to the pavement, and she then rushed to his aid. Fortunately, she was uninjured in the incident.
When Good Samaritans Help
When someone stops to help out in an emergency, they often save lives and provide a valuable service to their fellow man. However, what happens if the helper is injured? Who is going to pay for his or her injuries?
This is a difficult question and there is not quick answer. Generally speaking, the Good Samaritan can make a claim against the at-fault driver, but there’s no guarantee that it will work out. Sometimes the person might be able to make a claim on their own insurance policy. Or if they were hit by a car after they got out to help, then they might have a claim against that driver.
So What if the Good Samaritan Makes Things Worse?
Unfortunately, it’s a real possibility that in trying to help, a well-meaning person might injure someone further. But in most states, including Pennsylvania, have Good Samaritan laws that protect a person from liability when genuinely trying to help.
Do I need an Attorney if I am hit as a Pedestrian?
Many drivers who flee the scene are intoxicated or hiding something. If you were hit by a drunk driver or involved in any type of crash which resulted in a serious injury,it is very important to speak to an attorney as soon as possible.
Insurers will often try to blame you for your own injuries, especially if you were a pedestrian.
